St\u00e1t tla\u010d\u00ed na digitalizaci, Evropsk\u00e1 unie na transparentnost, demografick\u00fd a soci\u00e1ln\u00ed v\u00fdvoj na flexibilitu. V\u00fdsledkem je legislativa, kter\u00e1 zvy\u0161uje n\u00e1roky na \u0159\u00edzen\u00ed lid\u00ed, mzdovou politiku i HR procesy. <\/b><\/strong><span id=\"more-19069\"><\/span><\/p>\n<p style=\"text-align: justify;\"><em><i>\u201e\u010cesk\u00fd pracovn\u00ed trh vstupuje do dal\u0161\u00ed f\u00e1ze legislativn\u00edch zm\u011bn, kter\u00e9 se od p\u0159\u00ed\u0161t\u00edho roku v\u00fdrazn\u011b dotknou jak zam\u011bstnavatel\u016f, tak zam\u011bstnanc\u016f. Po velk\u00fdch zm\u011bn\u00e1ch, kter\u00e9 p\u0159inesla tzv. flexinovela, p\u0159ich\u00e1z\u00ed dal\u0161\u00ed sada opat\u0159en\u00ed, jejich\u017e spole\u010dn\u00fdm jmenovatelem je digitalizace st\u00e1tn\u00ed spr\u00e1vy, snaha o v\u011bt\u0161\u00ed rovnov\u00e1hu mezi flexibilitou a ochranou pracovn\u00edk\u016f, boj proti neleg\u00e1ln\u00edmu zam\u011bstn\u00e1v\u00e1n\u00ed a vy\u0161\u0161\u00ed transparentnost. Pro firmy to znamen\u00e1 nutnost p\u0159ipravit se nejen procesn\u011b, ale i kulturn\u011b, proto\u017ee \u010d\u00e1st zm\u011bn zasahuje p\u0159\u00edmo do zp\u016fsobu odm\u011b\u0148ov\u00e1n\u00ed, n\u00e1boru i \u0159\u00edzen\u00ed lid\u00ed,\u201c <\/i><\/em>\u0159\u00edk\u00e1<strong> Jaroslava Rezlerov\u00e1,<\/strong> gener\u00e1ln\u00ed \u0159editelka ManpowerGroup \u010cesk\u00e1 republika a prezidentka Asociace personalist\u016f \u010cR.<\/p>\n<p style=\"text-align: justify;\">Jednou z nejv\u00fdznamn\u011bj\u0161\u00edch novinek je zaveden\u00ed <strong><b>Jednotn\u00e9ho m\u011bs\u00ed\u010dn\u00edho hl\u00e1\u0161en\u00ed zam\u011bstnavatele<\/b><\/strong>, kter\u00e9 m\u00e1 nahradit dosavadn\u00ed rozt\u0159\u00ed\u0161t\u011bn\u00fd syst\u00e9m oznamovac\u00edch povinnost\u00ed v\u016f\u010di n\u011bkolika instituc\u00edm. Nov\u00fd model po\u010d\u00edt\u00e1 s pln\u011b elektronick\u00fdm hl\u00e1\u0161en\u00edm dat o zam\u011bstnanc\u00edch v r\u00e1mci jednoho m\u011bs\u00ed\u010dn\u00edho v\u00fdstupu, \u010d\u00edm\u017e by se m\u011bla sn\u00ed\u017eit administrativn\u00ed z\u00e1t\u011b\u017e zejm\u00e9na pro firmy s vy\u0161\u0161\u00ed fluktuac\u00ed nebo v\u011bt\u0161\u00edm po\u010dtem dohod\u00e1\u0159\u016f. St\u00e1t t\u00edm reaguje na dlouhodobou kritiku zam\u011bstnavatel\u016f, podle kter\u00fdch se person\u00e1ln\u00ed agenda st\u00e1v\u00e1 ne\u00fam\u011brn\u011b slo\u017eitou a n\u00e1kladnou, ani\u017e by p\u0159in\u00e1\u0161ela vy\u0161\u0161\u00ed p\u0159idanou hodnotu. JMKZ tak\u00e9 d\u00edky propojen\u00ed st\u00e1tn\u00edch syst\u00e9m\u016f umo\u017en\u00ed st\u00e1tu odhalovat r\u016fzn\u00e9 p\u0159\u00edpady neleg\u00e1ln\u00edho zam\u011bstn\u00e1v\u00e1n\u00ed, co\u017e bude m\u00edt na n\u011bkter\u00e9 sektory v\u00fdznamn\u00fd dopad.<\/p>\n<p style=\"text-align: justify;\"><strong>K velk\u00fdm zm\u011bn\u00e1m doch\u00e1z\u00ed u placen\u00ed odvod\u016f u dohod<\/strong><\/p>\n<p style=\"text-align: justify;\">Ve 2026 m\u00e1 doj\u00edt ke sjednocen\u00ed odvodov\u00fdch pravidel pro v\u0161echny dohody bez ohledu na po\u010det zam\u011bstnavatel\u016f. Znamen\u00e1 to, \u017ee limity pro neplacen\u00ed pojistn\u00e9ho se nebudou vztahovat k jednomu zam\u011bstnavateli, ale k jednotlivci. <em><i>\u201eZmiz\u00ed tak dosavadn\u00ed praxe mnoha firem, kumulace n\u011bkolika dohod bez odvod\u016f, kterou st\u00e1t dlouhodob\u011b kritizoval kv\u016fli \u00fanik\u016fm na soci\u00e1ln\u00edm a zdravotn\u00edm poji\u0161t\u011bn\u00ed. St\u00e1valo se pom\u011brn\u011b \u010dasto, \u017ee podnikatel vlastnil des\u00edtky s.r.o. a jeho zam\u011bstnanci \u201epap\u00edrov\u011b\u201c pracovali ka\u017ed\u00fd den u jin\u00e9 firmy na DPP. Vyhnuli se tak odvod\u016fm poji\u0161t\u011bn\u00ed, kter\u00e9 je v\u00a0\u010cR velmi vysok\u00e9 jak pro zam\u011bstnance, tak hlavn\u011b zam\u011bstnavatele,\u201c<\/i><\/em>\u00a0\u0159\u00edk\u00e1 Jaroslava Rezlerov\u00e1.<\/p>\n<p style=\"text-align: justify;\">Smyslem zm\u011bn je zv\u00fd\u0161en\u00ed ochrany dohod\u00e1\u0159\u016f a narovn\u00e1n\u00ed odvodov\u00e9ho syst\u00e9mu. Vedlej\u0161\u00edm efektem bude bohu\u017eel vy\u0161\u0161\u00ed administrativn\u00ed z\u00e1t\u011b\u017e a zdra\u017een\u00ed kr\u00e1tkodob\u00e9 pr\u00e1ce, co\u017e se m\u016f\u017ee dotknout nab\u00eddky brig\u00e1d. Pro zam\u011bstnavatele to p\u0159edstavuje nov\u00fd re\u017eim kontroly celkov\u00e9ho p\u0159\u00edjmu pracovn\u00edka a povinnost odv\u00e1d\u011bt pojistn\u00e9 i v p\u0159\u00edpadech, kdy to d\u0159\u00edve nutn\u00e9 nebylo. Dohod\u00e1\u0159i budou muset pe\u010dliv\u011b hl\u00eddat limity, proto\u017ee jejich p\u0159ekro\u010den\u00ed se hned projev\u00ed v \u010dist\u00e9 mzd\u011b. Firmy, kter\u00e9 stav\u011bly sezonn\u00ed provoz na pr\u00e1ci dohod\u00e1\u0159\u016f, si budou muset spo\u010d\u00edtat, zda se jim tento model je\u0161t\u011b vyplat\u00ed. \u010c\u00e1st zam\u011bstnavatel\u016f pravd\u011bpodobn\u011b p\u0159ejde na DP\u010c nebo kr\u00e1tk\u00e9 pracovn\u00ed \u00favazky, proto\u017ee administrativn\u00ed n\u00e1ro\u010dnost bude podobn\u00e1, ale pr\u00e1vn\u00ed jistoty v\u011bt\u0161\u00ed. To ostatn\u011b pozorujeme u\u017e dnes, kdy novela z roku 2023 z\u00e1sadn\u011b p\u0159ibl\u00ed\u017eila re\u017eim dohod b\u011b\u017en\u00fdm smlouv\u00e1m a p\u0159inesla povinnost pl\u00e1novat sm\u011bny, evidovat p\u0159\u00edplatky i n\u00e1rok na dovolenou.<\/p>\n<p style=\"text-align: justify;\"><em><i>\u201ePokud chceme ochr\u00e1nit pracovn\u00edky, ale z\u00e1rove\u0148 zachovat funk\u010dn\u00ed ekonomiku, bude nutn\u00e9 p\u0159em\u00fd\u0161let v \u0161ir\u0161\u00edch souvislostech. Bez modernizace z\u00e1kon\u00edku pr\u00e1ce, podpo\u0159en\u00ed \u010d\u00e1ste\u010dn\u00fdch \u00favazk\u016f, zjednodu\u0161en\u00ed administrativy a pos\u00edlen\u00ed \u0159\u00edzen\u00e9 migrace se flexibilita trhu pr\u00e1ce bude d\u00e1l zmen\u0161ovat a d\u016fsledky nepoc\u00edt\u00ed jen brig\u00e1dn\u00edci, ale i firmy a z\u00e1kazn\u00edci,\u201c<\/i><\/em>\u00a0\u0159\u00edk\u00e1 Jaroslava Rezlerov\u00e1.<\/p>\n<p style=\"text-align: justify;\">Z\u00e1sadn\u00ed dopad na firemn\u00ed kulturu i mzdovou politiku m\u016f\u017ee m\u00edt evropsk\u00e1 <strong><b>sm\u011brnice o rovnosti odm\u011b\u0148ov\u00e1n\u00ed<\/b><\/strong>\u00a0a bude velmi z\u00e1le\u017eet na tom, jak\u00fdm zp\u016fsobem p\u0159istoup\u00edme k\u00a0jej\u00ed transpozici a na jak\u00fdch principech ji postav\u00edme. C\u00edlem sm\u011brnice je vy\u0161\u0161\u00ed mzdov\u00e1 transparentnost, v\u010detn\u011b zve\u0159ej\u0148ov\u00e1n\u00ed mzdov\u00fdch rozmez\u00ed u srovnateln\u00fdch pozic a pr\u00e1va zam\u011bstnanc\u016f z\u00edskat informace o pr\u016fm\u011brn\u00e9 odm\u011bn\u011b na obdobn\u00e9 pozici. Pokud rozd\u00edl v odm\u011b\u0148ov\u00e1n\u00ed \u017een a mu\u017e\u016f p\u0159es\u00e1hne p\u011bt procent, bude jej muset zam\u011bstnavatel objektivn\u011b vysv\u011btlit. \u010cesk\u00e1 republika dlouhodob\u011b pat\u0159\u00ed k zem\u00edm s nadpr\u016fm\u011brn\u00fdm gender pay gapem, kter\u00fd podle dat Eurostatu \u010din\u00ed zhruba 16 procent, a i po o\u010di\u0161t\u011bn\u00ed o srovnateln\u00e9 pozice z\u016fst\u00e1v\u00e1 kolem deseti procent. Nov\u00e1 pravidla tak vytv\u00e1\u0159ej\u00ed tlak na systemati\u010dt\u011bj\u0161\u00ed pr\u00e1ci s mzdov\u00fdmi daty a f\u00e9rov\u011bj\u0161\u00ed nastavov\u00e1n\u00ed odm\u011b\u0148ov\u00e1n\u00ed nap\u0159\u00ed\u010d organizacemi. <em><i>\u201eV\u011bt\u0161ina firem nikoho diskriminovat nechce. Praxe ale ukazuje, \u017ee k t\u011bmto rozd\u00edl\u016fm doch\u00e1z\u00ed nev\u011bdom\u011b, proto\u017ee je jednodu\u0161e nikdo nesleduje. Nov\u00e1 pravidla je mohou p\u0159im\u011bt k tomu, aby si za\u010daly d\u011blat intern\u00ed anal\u00fdzy a p\u0159\u00edpadn\u00e9 nesrovnalosti \u0159e\u0161it. P\u0159esto\u017ee od t\u011bchto zm\u011bn nelze o\u010dek\u00e1vat okam\u017eit\u00e9 odstran\u011bn\u00ed nerovnost\u00ed, jde o d\u016fle\u017eit\u00fd krok ke zm\u011bn\u011b my\u0161len\u00ed \u0161\u00e9f\u016f firem a pos\u00edlen\u00ed transparentnosti na trhu pr\u00e1ce. A nejde jen o \u017eeny. Otev\u0159en\u011bj\u0161\u00ed syst\u00e9m odm\u011b\u0148ov\u00e1n\u00ed prosp\u00edv\u00e1 v\u0161em uchaze\u010d\u016fm o pr\u00e1ci,\u201c<\/i><\/em>\u00a0\u0159\u00edk\u00e1 Jaroslava Rezlerov\u00e1.<\/p>\n<p style=\"text-align: justify;\">V\u00fdznamn\u00e1 debata se vede tak\u00e9 kolem povinnosti zam\u011bstnavatel\u016f p\u0159isp\u00edvat <strong><b>na penzijn\u00ed p\u0159ipoji\u0161t\u011bn\u00ed<\/b><\/strong>\u00a0zam\u011bstnanc\u016fm pracuj\u00edc\u00edm ve t\u0159et\u00ed kategorii prac\u00ed podle kategorizace prac\u00ed. Smyslem opat\u0159en\u00ed je zohlednit vy\u0161\u0161\u00ed zdravotn\u00ed z\u00e1t\u011b\u017e t\u011bchto profes\u00ed a pos\u00edlit jejich soci\u00e1ln\u00ed zabezpe\u010den\u00ed do budoucna. P\u0159esto\u017ee se jedn\u00e1 o logick\u00fd krok z pohledu ochrany zam\u011bstnanc\u016f, firmy upozor\u0148uj\u00ed na dal\u0161\u00ed n\u00e1r\u016fst n\u00e1klad\u016f v segmentech, kter\u00e9 ji\u017e dnes \u010del\u00ed siln\u00e9mu tlaku na mzdy a nedostatku pracovn\u00ed s\u00edly.<\/p>\n<p style=\"text-align: justify;\">Na stran\u011b zam\u011bstnanc\u016f se od roku 2026 prom\u00edtne do praxe n\u011bkolik zm\u011bn s p\u0159\u00edm\u00fdm dopadem na p\u0159\u00edjem. <strong><b>Minim\u00e1ln\u00ed mzda se zvy\u0161uje na 22 400 korun m\u011bs\u00ed\u010dn\u011b<\/b><\/strong>, respektive 134,40 koruny na hodinu, co\u017e posiluje p\u0159\u00edjmy nejh\u016f\u0159e placen\u00fdch pracovn\u00edk\u016f, ale z\u00e1rove\u0148 zvy\u0161uje mzdov\u00e9 n\u00e1klady zam\u011bstnavatel\u016fm zejm\u00e9na v pracovn\u011b n\u00e1ro\u010dn\u00fdch provozech. U dohod o proveden\u00ed pr\u00e1ce doch\u00e1z\u00ed k <strong><b>nav\u00fd\u0161en\u00ed hranice pro odvody o 500 K\u010d na 12 000<\/b><\/strong>.<\/p>\n<p style=\"text-align: justify;\">Do legislativn\u00edho r\u00e1mce se z\u00e1rove\u0148 prom\u00edtaj\u00ed zm\u011bny takzvan\u00e9 <strong><b>flexinovely z\u00e1kon\u00edku pr\u00e1ce<\/b><\/strong>. Ty maj\u00ed za c\u00edl zv\u00fd\u0161it flexibilitu pracovn\u011bpr\u00e1vn\u00edch vztah\u016f, upravit pravidla zku\u0161ebn\u00ed doby, v\u00fdpov\u011bdn\u00edch lh\u016ft a pos\u00edlit elektronickou komunikaci mezi zam\u011bstnavatelem a zam\u011bstnancem. Jde o reakci na realitu trhu pr\u00e1ce, kter\u00fd se rychle m\u011bn\u00ed pod vlivem technologi\u00ed, demografie i prom\u011bny o\u010dek\u00e1v\u00e1n\u00ed zam\u011bstnanc\u016f, zejm\u00e9na mlad\u0161\u00edch generac\u00ed.<\/p>\n<p style=\"text-align: justify;\"><em><i>\u201eSouhrn t\u011bchto zm\u011bn ukazuje, \u017ee se \u010desk\u00fd pracovn\u00ed trh posouv\u00e1 sm\u011brem k v\u011bt\u0161\u00ed regulaci, transparentnosti a digitalizaci. Pro zam\u011bstnavatele to znamen\u00e1 nutnost strategick\u00e9ho p\u0159\u00edstupu k HR, pr\u00e1ci s daty a otev\u0159en\u00e9 komunikaci se zam\u011bstnanci. Pro zam\u011bstnance pak vy\u0161\u0161\u00ed m\u00edru ochrany, informovanosti a p\u0159edv\u00eddatelnosti.
